Has anyone actually contacted activision and inquired about the possability of them Opensourcing the MW2 source code????

We have been asking for the source code time and again, never getting (much of) a response. By now I think we have little use for it. We have uncovered most of the file formats involved, and MechVM duplicates most of the functionality of MW2 shell. I am close to completing a new Mech Lab for MechVM. You can take a look at the current state of these features in MechVM if you remove the # character before the line experimental_features in MechVM.cfg. Then reinstall the games, and you will receive additional options in MechVM's "Play Game" screen. These options will use MechVM's shell emulation and MechVM's Mech Lab, and MW2's simulation. The emulation does not yet include animations or sound, but I do not see this as a major obstacle.
With much of the shell rewritten, and our ability to invoke the sim with a wide variety of parameters, the question is not so much if we have the source code. The source code of MW2 contains many bugs, was written for outdated hardware and OS concepts. The question is what you want to do with MW2. If you look around the forum, especially the development sections, you will find lots of information that you can use to create Mechs, levels, and whatever else you please. Be our guest, use this information and make us go "Wow!" with mods.
Recently, I even found the time to work on my sim again. Mechs now drop to the ground and can walk around, but these features are far from being ready for release. But it still is a huge step forward, considering that only collision detection and weapon damage remain to make this game playable in principle. We can discuss eye candy when that is done.

i had found a torrent file called DOS-cary contains of mech2 DOS and gbl so basically ask him if he has the source code

I checked those torrents, I wouldn't go in that route. The thing is, they run off the minimal installation features (around 42 MB, recommended is 80 MB and full-blown is 152 MB) so unless you have a Mech2 disc, you're a bit out of luck in terms of what's installed (voices, movies, and animations). If anyone wants to peg him for the full features, be my guest.
If you're wondering how I knew, I used a GBL disc (it's possible you can use a GBL disc to run Mech2 31CC and still have everything running, I checked that for Win with a full-blown install, not sure for DOS and other install methods).
